The Supreme Court has unanimously rejected an injunction application submitted by suspended Chief Justice Gertrude Araba Esaaba Sackey Torkornoo, which aimed to prevent the proceedings of a presidential committee that is investigating petitions for her removal from her position.
Justice Torkornoo submitted the application on Wednesday, May 21, 2025, requesting the apex court to grant an interlocutory injunction against the six-member committee appointed by President John Mahama.
The purpose of the application was to prohibit the committee from conducting any inquiries related to the petitions until the main case is resolved.
As per court documents, the Chief Justice sought a specific order to prevent Justices Gabriel Scott Pwamang and Samuel Kwame Adibu-Asiedu, along with other committee members such as Daniel Yao Domelevo, Major Flora Bazuwaaruah Dalugo, and Professor James Sefah Dziasah, from engaging in the investigation.
Additionally, she requested that Justices Pwamang and Adibu-Asiedu be disqualified from overseeing or participating in the committee’s discussions.
Nevertheless, the Supreme Court, in a unanimous decision on Wednesday, May 28, dismissed the application. The complete written ruling is anticipated to be released on June 12, 2025.
This ruling represents a crucial development in the ongoing legal dispute regarding the suspension of Justice Torkornoo and the constitutional issues it raises.
