The former Managing Director of SIC Insurance Company Limited, Ms. Hollistar Duah-Yentumi, has initiated legal proceedings against the company and its newly appointed Managing Director, Mr. James Agyenim-Boateng.
On January 27, President John Dramani Mahama announced Mr. Agyenim-Boateng as the successor to Ms. Hollistar Duah-Yentumi; however, she contested this appointment through a lawsuit filed on February 4.
In her legal claim, Ms. Hollistar Duah-Yentumi contends that “according to the agreement, the Plaintiff’s tenure as Managing Director is set for a duration of four years, concluding on January 1, 2028, or at a later date as may be mutually agreed upon by the Board of Directors of the first Defendant and the Plaintiff.”
She further asserts that “all terms pertaining to the Plaintiff’s employment as Managing Director of the publicly listed company, the first Defendant, are exclusively governed by the employment agreement executed by both parties,” as stated in part of the suit.
Additionally, Ms. Hollistar Duah-Yentumi claims that “concerning the termination of the Plaintiff’s employment, it is stipulated in clause 7 of the agreement that the Plaintiff’s employment can only be terminated by the board of directors of the first Defendant or by all shareholders of the company during an Annual General Meeting convened for that purpose.”
Consequently, the suit requests the High Court to declare “that the alleged termination of the Plaintiff’s employment as Managing Director of the first Defendant is unlawful and constitutes a breach of the employment contract executed between the Plaintiff and the first Defendant,” and that “the alleged appointment of the second Defendant as the Managing Director of the first Defendant is also unlawful.”
The legal representatives are additionally seeking “an order requiring the Defendants to pay the Plaintiff’s full salary and benefits for the remaining duration of the employment contract, as detailed in paragraphs 11 and 12 of the suit.”
