Alan Kwadwo Kyerematen, the Presidential Candidate of the Movement for Change, is calling on Speaker of Parliament Alban Bagbin to adhere to the Supreme Court’s decision regarding the injunction on his declaration of four parliamentary seats as vacant. Additionally, Kyerematen is urging Bagbin to quickly address the application made by Majority Leader Afenyo-Markin that resulted in the injunction.
Kyerematen praised the Speaker for vacating the seats, but criticized his decision to challenge the Supreme Court’s original jurisdiction in legal interpretation, calling it misguided.
He stressed the importance of the Supreme Court upholding the principle of separation of powers and recognizing Parliament’s independence in matters involving the Speaker.
Kyerematen emphasized the importance of collaboration among government branches, warning that prolonged disputes could have adverse effects as elections drew near. He urged for a prompt resolution to the issue.
Bagbin must acknowledge the Supreme Court’s decision to grant an injunction that halts the execution of his original order. He must come to terms with the Supreme Court’s second decision to reject their application.
He must submit a new application to the Supreme Court asking for a revision of its previous decision to issue an injunction regarding the issue.
The application must be based on the fact that there are no interpretation issues arising from the provisions of the Constitution. Therefore, Afenyo-Markin’s application to the Supreme Court to injunct Parliament and stay the execution of the Speaker’s ruling is not appropriate.
If there is no need for interpretation of a specific provision, then it is inappropriate to compel the Supreme Court to provide an interpretation.
