President John Dramani Mahama has, in line with Article 146(9) of the 1992 Constitution, dismissed the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo, from her position effective immediately.
This action follows the receipt of the report from the Committee of Inquiry, which was established under Article 146(6) of the Constitution to investigate a petition filed by a Ghanaian citizen, Mr. Daniel Ofori, requesting the Chief Justice’s removal.
Upon reviewing the petition, along with extensive evidence and testimonies, the Committee determined that the allegations of misconduct as outlined in Article 146(1) were sufficiently substantiated. Consequently, it has recommended her removal from office.
According to Article 146(9) of the Constitution, the President is obligated to act in accordance with the findings and recommendations of the Committee.
In a statement made on Monday, September 1, 2025, the President’s Spokesperson and Minister for Government Communications, Felix Kwakye Ofosu, announced that the Chief Justice’s removal was executed in compliance with the law.
He reassured the public that the process was carried out with strict adherence to constitutional protocols, ensuring that both the petitioner and the Chief Justice were given ample opportunity to present their cases before the Committee.
